1. Copyright
Copyright applies to any original material, published or unpublished,
created by anyone. Under United States (and international)
law, you have a right to the work which you have created,
be it a work of authorship, photography, musical composition,
etc. Antarians.com claims that right for its webpage.
2. Filing for Copyright Protection
Contrary to a common misconception, filing for copyright protection
is not a requirement to obtain a copyright. As stated
above, all orginal works are inherently the property of their
author(s). Antarians.com has nonetheless filed for copyright
protection and will act to guard its interests.
3. Fair Use
Some webmasters erroneously believe
that they may use any content, regardless of copyright, provided
they cite their source. This is far from the truth. The concept
of Fair Use is described in Section 110 (5) of the Copyright
Act of 1976 and states that work may be reprinted without
permission only when brief passages are used for
journalistic, editorial, scholastic, and similar purposes,
and only if the source is properly cited. Simply put: if you
do not cite your source, you are stealing. If you do cite
your source, you still may exceed the limits of fair use.
4. Original Material at Antarians.com
Most of the content found at Antarians.com is original material.
Some is not. If you consider reprinting any material found
at this site, please make sure you understand which is which.
Our copyrighted material includes,
but is not limited to: our site introduction, transcripts,
buddy icons, wallpapers, character profiles, actor biographies,
special features, site layouts, etc.
Some materials seem to fall into a gray area regarding
copyright. For instance, "Liz's Journal" is a part of the
copyrighted Roswell television show. The Antarians.com
transcript of Liz's Journal, however, is original work and
is therefore our property. Similar reasoning applies to
the Destiny Book, the Crashdown Cafe Menu, and others. While
the original concepts remain property of the owners, our
interpretations remain our own. Any site may publish
its own transcripts, but format and grammatical interpretations
create differences between each.
Materials to which Antarians.com does not own the copyright
are scripts, the Roswell font, fan submissions,
many of our gallery photographs, etc. Antarians.com makes
every effort to obtain the permission of the owner before
using any materials. However, because of the nature of a
fan site dedicated to a copyrighted television show, some
copyrighted material may possibly become posted on Antarians.com
unintentionally. Many photographs which have propagated
throughout the internet are impossible to trace to their
original owners. Much of what has been published has essentially
become part of the public domain. And finally, we assume
that corporate copyright holders such as Fox are willing
to lend portions of their material due to the publicity
gained through active fan sites. All material at Antarians.com
is posted in good faith. If we have infringed on your copyright,
or you feel that we may be infringing on another party's
copyright, please let us know and we will promptly remove
it with our apologies.
5. Final Notes
The staff at Antarians.com puts a great
deal of time and effort into producing this site, which we
offer as a free community resource. We expect all visitors
to abide by copyright law. Once again, Antarians.com monitors
the Internet for sites which may be using our work without
permission. Appropriate action will be taken against any sites
which violate our copyright. If you are interested in reprinting our
work, just e-mail us and we will consider granting permission.
Copyright law allows content creators to maintain a reasonable
control of their work, without which many might be discouraged
